No-fault benefits can apply to both parties

No-fault benefits are the responsibility of the ICBC adjuster. You can apply for no-fault benefits regardless of who was at fault for the accident as long as you or your motor vehicle was insured by ICBC, even if the accident was out-of-province or in the U.S.A. The no-fault benefits can include funeral expenses, death benefits, income replacement, rehabilitation and reasonable medical expenses up to a limit of $150,000 per person.

A claim for no-fault benefits does not increase your ICBC premiums in the future. No-fault benefits are limited and do not necessarily compensate you fully for the personal injuries you have suffered.
