Steps to follow when filing your personal injury claim

There are some basic steps that must be taken for most personal injury lawsuits to move forward. The following list is adapted from the Law Society of British Columbia’s explanation for the steps in a lawsuit, and also incorporates steps that we believe should be completed to best position your case for success. Because every case is different, sometimes some steps are skipped, while others might be repeated or can occur in a different order.

Reporting the Accident to ICBC

To protect your rights to ICBC Accident Benefits, you must report the accident to ICBC by calling Dial-a-Claim as soon as possible (preferably within 24-48 hours after the accident). Note that what you say to ICBC will be recorded and passed on to the ICBC adjuster assigned to your claim file.

You will be asked to make an appointment to see an ICBC adjuster (if you are injured) and an ICBC estimator (if there is damage to your vehicle).

DO NOT be rushed into taking the first available appointment. Give yourself time to obtain legal advice and seek medical treatment.

Seek medical attention as soon as possible. Even if you were taken to the hospital, go see your family doctor to start the record of your injuries with their office.
